          I am directed to stat that the Governor of the Punjab has been pleased to upgrade all technical non-technical employees holding posts in BS-5 to BS-16 which are isolate/stagnant (i.e., having no promotion prospects) and have 10 years service to their credit in the respect pay scale, to next pay scale w.e.f. 01-01-2016.  The incumbents shall further be promoted to next pay scale after earning of each 10 years of service.

  1. All the department / attached departments are requested to take further necessary action to implement the above policy and will strictly observe prescribed procedure for promotion of these employees i.e. through DPC for ascertaining of service record. However, the immediate up-gradation is without DPC.
  2. The above employees are not entitled to premature increment either on up-gradation 01-01-2016 or time scale promotion after each 10 years.

In terms of Notification No.FD.PC.40-80/2015 dated  26-07-2017, the post of Sub-Engineer has been upgraded from BS-11 to BS-14 in terms of Notification No. FD.PC.39-14/77-P-IV.APCA/2008(Provl) dated 04-01-2016 (copy enclosed) all technical / non-technical employees holding posts from BS-5 to Bs-15 which are isolated / stagnant (i.e. having no promotion prospects) and have 10-years service to their credit in the respective pay scale, were upgraded to next pay scale w.e.f. 01-01-2016 and further no next pay scale after earning each 10 years of service (Annexure-A).

In supersession of letter dated 04-01-2016, time scale promotions to the employees in BS-5 to BS-15  holding promotion / non-promotion posts, where none or only one-time promotion in the entire service is prescribed in the rules was on satisfactory completion of each 10 years of service as under vide Notification No.FD.PC.40-80/2015 dated  26-07-2017.

ii A confusion has arisen at which of the above circulars is to be implemented first or both will be implemented simultaneously.  For illustration, the post of Sub-Engineer has been upgraded from BS-11 to BS-14.  A Sub-Engineer claims time scale promotion in BS-16.

In case the pay of employee is first fixed in time scale promotion, it will come to BS-13 (two steps) and thereafter his pay is fixed under up-gradation, it will come to BS-15. In case the pay is fixed in upgraded post in the first instance it becomes to BS-14.  Thereafter by allowing him two steps promotion, it will come to BS-16.  This office may therefore kindly be favored with a valuable advice as to which circular letter the pay of the Sub-Engineer may first be fixed.

In terms of Notification No.FD.PC.40-80/2015 dated 26-07-2017, the post of Sub-Engineer has been upgraded from BS-11 to BS-14 in terms of Notification No. FD.PC.39-14/77-P-IV.APCA/2008(Provl) dated 04-01-2016 (copy enclosed) all technical / non-technical employees holding posts from BS-5 to Bs-15 which are isolated / stagnant (i.e. having no promotion prospects) and have 10-years service to the extent indicated in sub-Para (i) above.

A Sub Engineer first gets promotion as Senior Sub-Engineer (BS-16) and then Assistant Engineer / Sub Divisional Officer (BS-17).  Hence the policy of time scale promotion is not applicable in such cases. However, if nor or only one-time promotion in the entire service is prescribed in the rules in a specific case, such Sub-Engineer after getting the benefit of upgrading BS-11 to BS-14 w.e.f. 26-08-2017 will have to wait for 10 year in BS-14 to get the benefit of time scale promotion in BS-15 and further ten years of BS-16.

  In case the pay of a Sub-Engineer is fixed in BS-16, whether it will be gazetted or non gazetted. The Time Scale Promotion is considered as personal up-gradation. Hence an official availing the benefit of time scale promotion in BS-16 cannot be declared as officer. However, such incumbents entitled to pay and allowances as admissible to an officer of BS-16.

I am directed to refer to the subject cited above and to state that a question has arisen as to whether Time Scale Personal Upgradation is admissible to the employees who is appointed against a post having no upper tier/line of promotion and has two mode of appointments I.e. by initial recruitment as well as by promotion.

            I am directed to refer to this Department’s Notifications Nos. FD.pc40-12/2017 dated 19-04-201910-07-2019, 26-07-2019 & 20-12-2019 & clarification bearing No.FD.PC.40-80/15(115-19) dated 03-02-2019, on the subject cited above and to state that a question has arisen regarding factors in absence of which Grant of Time Scale  Personal Up-gradation to an officer/official may be considered in accordance with the applicable policy.

  1. The case has been examined and it is clarified that an officer/official who has completed 10 years in a basic pay scale may be given Time Scale Personal Up gradation in the light of Finance Department’s Notifications stated above if
  1. He/she is not hit by Para-24 of Promotion Policy-2010. It would be pertinent to mention that under Para 24 ibid the impact of foregoing of promotion is supersession.  In case promotee foregoes promotion once, he / she is superseded for three years but the second foregoing superseded permanently.
  2. No challan/reference has been filed by an Investigation Agency against him /her, and
  • He/she has not been awarded major penalty. If he/she has been awarded major penalty then subject to the following:-
  1. In case of recovery of pecuniary loss, more than five years have elapsed since start of recovery and at least 50% has been made.
  2. In case of reduction to a lower post and pay scale from the substantive or regular post for a specific period two years have elapsed to the completion of this period.
  3. In case of forfeiture of service, forfeiture period will be deducted for calculating of service period of 10 years for Time Scale Personal Up-gradation and further two years have elapsed to the imposition of penalty.

It is to inform that a letter has been issued vide the above referred letter dated 10-07-2019 regarding explanation for grant of time scale promotion to the officers of BS-16 & above. The Para 5 of the letter prescribed that  the eligible person shall simply apply to the concerned Accountant General Punjab/ District Accounts Officer  as the case may be, for grant of time scale promotion and get their pay slips issued w.e.f.02-02-2019, without conducting any DPC performance reports, disciplinary proceedings, issuance of formal orders etc.

 

In case of officers, the advice referred above to Para 5 of this Department’s letter of even number dated 10-07-2019 will be issued by the Head of Attached Department, or where there is no attached department by the Administrative Department.  Only those officers are authorized to approach your office or as the case may be, the concerned District Accounts Office who are advised to apply for the issuance of the revised pay slips. This advice may served as orders for the time scale promotion.  In case of officials in BS-1 to BS-15, mere entries by the concerned Drawing and Disbursing Officers in the service books of the officials would suffice as already clarified vide Para 2 (ii) of the Finance Department U.O. No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 09-08-2016.
ii As provided in Para 1 (i) of the Government of the Punjab Finance Department Policy letter No. FD.PC.40-12/2017 dated 19-04-2019, the promotion is subject to the condition “that they possess good/satisfactory service record” The audit office maintains the service record of pay and allowances but record of litigation, inquiries, ACRs etc. is with the Administrative Department so the implementation of the above policy without formal orders or DPC. There should be condition of DPC or at least the condition of issuance of formal orders by the concerned administrative departments & to cover the issue of satisfactory service, disciplinary proceedings, and length of service of the employee and stagnancy of the posts according to the service rules of the post. As against S.No. (i) above.

As regard condition of DPC. It has already been clarified vide Para 2 (i) of the Finance Department U.O. No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 09-08-2016, read with letter No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 04-01-2016, that time scale promotion is allowed without DPC. The above referred letters have already been implemented by your office and DAOs in Punjab.

 

iii Some Departments are autonomous and do not draw from the A.G. Punjab / DAOs like Service Hospital Lahore, General Hospital, PMU etc., and hence no proper record of the officers is available with the Audit Office. Some officers became absconder and their proceedings are not been shared with the audit offices for years intentionally. Maintenance and completion of service record (History of Service) of officers for whom the A G office/ DAOs are audit offices is the responsibility of AG offices / DAOs. These offices are required to issue revised pay slips to the extent of officers falling under their audit jurisdiction.
iv Some officer transferred from place to another or one office to other, what will be their status as most of the record in Audit offices is not updated. In case of transfer of an officer, the revised pay slip on account of time scale promotion will be issued by the audit office under whose jurisdiction the officer was working on 01-02-2019 and will be sent to the audit office under which the officer was subsequently transferred.
v Some Officers had worked in a cadre and then get new appointment in some other cadre or department etc. what will be the criteria for their promotion? Time scale promotion is admissible to officers /officials who have completed 10- years in a cadre in which promotion channel is available or on a stagnant post having no promotion channel and they have not joined any other cadre or post.
vi What will be the status of this scheme for the civil servants who have been upgraded or granted time scale earlier? Time scale promotion under this department’s letter number even dated 19-04-2019 is admissible to the officers /officials who have been upgraded earlier subject to the condition that they have completed 10- years service in the upgraded BS.
vii Whether the time scale promotion is admissible to the officers working in BS-20 or BS-21? Subject to the eligibility, this department’s even number letter dated 19-04-2019 is applicable to all officers.
viii It is submitted that the condition of issuance of formal orders / conducting of DPC etc. may be considered. This office is of the view that formal orders must be issued by the Administrative Department concerned to share the responsibility as well as grant of Time Scale Promotion to the proper person accurately in transparent manner due to the reasons as detailed in Para No.3 above. As against Sr. No. (i) and (ii) above.

Moreover advice to be issued by the attached department or as the case may be treated as formal orders for the time scale promotion.

It is further added that the benefit of time scale promotion is to the extent of personal up gradation only.

Formal promotion in cases where promotion channel is available shall continue to be made in the prescribed manners.

  1. Finance Department observes that Mr. Anis-ur-Rehman was appointed as Stenographer (BS-12) on 27.04.1981 in Revenue Department. He was granted selection Grade in BS-15 w.e.f. 01.12.1991.Since then, he is working in the same scale He has Not been promoted against any higher post even after lapse of 25 years.
  1. Normally, the incumbents of the post of Stenographer are given promotion channel in all over the Punjab. But, perusal of facts of the instant case reveals that the official is working in the same scale for the last 25 years. Hence, the case of above said employees is covered under the policy of time scale promotion
  2. In view of the above, he is allowed only BS-16 w.e.f. 01.01.2016. However,

  1. Finance Department observes that the applicants who were appointed as Stenographer BS-12.  They were granted Selection Grade in BS-15.  They are working in the same scale for the last more than 20-years and they have not been promoted against any higher post.
  2. Normally, the incumbents of the post of Stenographer are given promotion channel in all over the Punjab. But, perusal of the facts of the instant cases reveals that the officials are working in the same scale for the last more than 20-years.  Hence the case of above said employees is covered under the policy of time scale promotion.

2                    Finance Department observes that Mr. Sanaullah was appointed as Stenographer (BS-12) on 18.111986 in the Office of Executive District Officer Agriculture Sahiwal. He was granted selection grade in BS-15 w.e.f. 31-01-1992.  Since then he is working in the same scale. He has not been promoted  against any post even after lapse of 24 years.  

3                     Normally, the incumbents of the post of Stenographer are given promotion Channel in all over the Punjab. But, perusal of facts o f the instant case reveals that the official is working in the same scale from the last 24 years. Hence the case of the above said employees is covered under the policy of time scale promotion.

  1. In view of the above, he is allowed only BS-16 w.e.f. 01-01-2016. However he will not be allowed move up to BS 17 keeping in view his 24 years’ service in the same scale as the incumbents of the higher tiers (Senior Scale Stenographers /Personal Assistant) working in BS-16 would agitate.

                       Kindly refer to Accountant General Punjab Lahore No. PR-13/HM/1037 dated 10-07-2021 on the subject cited above.

           It is submitted that time scale promotion was awarded by the Director-General Agriculture OFWM Punjab Lahore vide No. 2248-78/DGA/WM-3-188/Estt: Dated 30-01-2017 (Flag-A) in the light of Finance Department letter No. FD.PC.14/77(Pt.Iv) (APCA 2008)(Provl) dated 04-01-2016 (Flag-B) which was further clarified vide Notification No. FD.PD.14-38/78 (Pt.Iv) (Provl) dated 31-10-2016 (Flag-C).  The time scale was withdrawn vide this office order No. 6014-78/WM/3-579/Estt: dated 07-04-2017 (Flag-D).  In supersession of Notification No. FD.PC.14/77(Pt.Iv) (APCA 2008)(Provl) dated 04-01-2016 the said orders were restored on introduction of new Time Scale policy as conveyed vide Government of the Punjab Finance Department vide Notification No. FD.PC40-80/2015 dated 26-07-2017 (Flag-E),  As per this policy, on satisfactory completion of  each 10 years of service time scale was allowed to the employees of BS-5-15 holding promotion/non-promotion posts, where none or only one-time promotion in the entire service is prescribed in the rules.  According to the rules the incumbent of the BS-11 to BS-15 two steps time scale promotion after 10 years spell of service.

           It is pointed out that Mr. Javed Iqbal joined as Stenographer in 1987. He was never awarded any promotion till the grant of time scale 01-01-2016.  Therefore, as per new policy, he was entitled to grant of Time Scale.  Furthermore, as per Water Management Service Rules 2013 amended up to 28-01-2014, only one-time promotion was allowed as Senior Scale Stenographer.  But as explained above, he was not allowed any promotion despite more than 29 years of service before the award of Time Scale to BS-16. Therefore as per new policy he was allowed Time Scale from BS-15 to BS-16.

           In view of the above, it is indicated that no review of orders/clarification is required.  Mr. Javed Iqbal Stenographer is entitled to Time Scale promotion in BS-16, in the light of Finance Department’s Notification.

                   In continuation of this office letter No. NO.PR-13/HM/1037 DATED 10-07-2021 on the subject noted above.

  1. It is submitted that as per Finance Department letter No. FD.PC.40-80/2015 dated 26-07-2017 (copy enclosed) It was clearly mentioned that the time scale can only to those officers /officials who has isolated posts where none or only one-time promotion channel is available in the entire service. But in the instant case of Mr. Javed Iqbal Stenographer post has already more than two promotion channels i.e., Senior Scale Stenographer and then Superintendent. Therefore this post is not entitled for the right of time scale promotion i.e., BS-16.
  1. In view of the above original change form along with pay bill returned with the remarks that you are required to submit change form along with excess drawl amount in BS-16 which was drawn by the Mr. Javed Iqbal Superintendent in BS-16 w.e.f. 01-01-2016 to 30-09-2021, before execution of pay roll of November, 2021.
