Subject:           CLARIFICATION REGARDING NOTIFICATIONS DATED 14-12-2018                               ABOUT  UPGRADATION OF POSTS:

            I am directed to refer to this Department’s Notifications No. FD.PC.40-43/2017(A,B,C,D&E) Dated 14-12-2018 on the subject noted above.

  1. It is clarified for all concerned that:
  1. The incumbents of similarly placed posts, not mentioned in the above said Notifications will also be entitled to up-gradation/restructuring subject to clearance of Finance Department.
  2. The revised prescribed qualification mentioned in column “D” of above said Notifications will be incorporated in the service rules for promotion/fresh recruitment against the already available posts. However, amendment in service rules is not required for grant of Time Scale Promotion in accordance with the said Notifications where only one tier is available.
  • Restructuring in accordance with the above said Notifications will be made in accordance with the existing prescribed qualification instead of possessed qualification.
  1. Where only one tier is available and which has been upgraded, the incumbents of such posts will also be entitled to Time Scale Promotion as detailed in the above said Notifications, according to regular service after each 8 years.
  2. In case more than one tiers were available prior to issuance of Notifications dated 14-12-2018, these tiers would be restructured according to the said notifications through amendment in the service rules and restructured/upgraded posts would be filled by promotion or fresh recruitment as per revised prescribed qualifications mentioned in the above said Notifications.

 I am directed to refer to your letter No.TM-I/1-1A/LHC 2018-19 dated 17-07-2019 on t the subject noted above.

  1. The Finance Department has examined the queries raised in the letter referred to above which are hereby answered in annotated format.

It is to inform that a letter has been issued vide the above-referred letter dated 10-07-2019 regarding explanation for grant of time scale promotion to the officers of BS-16 & above. The Para 5 of the letter prescribed that  the eligible person shall simply apply to the concerned Accountant General Punjab/ District Accounts Officer  as the case may be, for grant of time scale promotion and get their pay slips issued w.e.f.02-02-2019, without conducting any DPC performance reports, disciplinary proceedings, issuance of formal orders etc.

 

In case of officers, the advice referred above to Para 5 of this Department’s letter of even number dated 10-07-2019 will be issued by the Head of Attached Department, or where there is no attached department by the Administrative Department.  Only those officers are authorized to approach your office or as the case may be, the concerned District Accounts Office who are advised to apply for the issuance of the revised pay slips. This advice may served as orders for the time scale promotion.  In case of officials in BS-1 to BS-15, mere entries by the concerned Drawing and Disbursing Officers in the service books of the officials would suffice as already clarified vide Para 2 (ii) of the Finance Department U.O. No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 09-08-2016.
ii As provided in Para 1 (i) of the Government of the Punjab Finance Department Policy letter No. FD.PC.40-12/2017 dated 19-04-2019, the promotion is subject to the condition “that they possess good/satisfactory service record” The audit office maintains the service record of pay and allowances but record of litigation, inquiries, ACRs etc. is with the Administrative Department so the implementation of the above policy without formal orders or DPC. There should be condition of DPC or at least the condition of issuance of formal orders by the concerned administrative departments & to cover the issue of satisfactory service, disciplinary proceedings, and length of service of the employee and stagnancy of the posts according to the service rules of the post. As against S.No. (i) above.

As regard condition of DPC. It has already been clarified vide Para 2 (i) of the Finance Department U.O. No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 09-08-2016, read with letter No. FD.P.C.39-14/77(PLIV)(APCA) (Provl) Dated 04-01-2016, that time scale promotion is allowed without DPC. The above-referred letters have already been implemented by your office and DAOs in Punjab.

 

iii Some Departments are autonomous and do not draw from the A.G. Punjab / DAOs like Service Hospital Lahore, General Hospital, PMU etc., and hence no proper record of the officers is available with the Audit Office. Some officers became absconder and their proceedings are not been shared with the audit offices for years intentionally. Maintenance and completion of service record (History of Service) of officers for whom the A G office/ DAOs are audit offices is the responsibility of AG offices / DAOs. These offices are required to issue revised pay slips to the extent of officers falling under their audit jurisdiction.
iv Some officer transferred from place to another or one office to other, what will be their status as most of the record in Audit offices is not updated. In case of transfer of an officer, the revised pay slip on account of time scale promotion will be issued by the audit office under whose jurisdiction the officer was working on 01-02-2019 and will be sent to the audit office under which the officer was subsequently transferred.
v Some Officers had worked in a cadre and then get new appointment in some other cadre or department etc. what will be the criteria for their promotion? Time scale promotion is admissible to officers /officials who have completed 10- years in a cadre in which promotion channel is available or on a stagnant post having no promotion channel and they have not joined any other cadre or post.
vi What will be the status of this scheme for the civil servants who have been upgraded or granted time scale earlier? Time scale promotion under this department’s letter number even dated 19-04-2019 is admissible to the officers /officials who have been upgraded earlier subject to the condition that they have completed 10- years service in the upgraded BS.
vii Whether the time scale promotion is admissible to the officers working in BS-20 or BS-21? Subject to the eligibility, this department’s even number-letter dated 19-04-2019 is applicable to all officers.
viii It is submitted that the condition of issuance of formal orders / conducting of DPC etc. may be considered. This office is of the view that formal orders must be issued by the Administrative Department concerned to share the responsibility as well as grant of Time Scale Promotion to the proper person accurately in transparent manner due to the reasons as detailed in Para No.3 above. As against Sr. No. (i) and (ii) above.

Moreover advice to be issued by the attached department or as the case may be treated as formal orders for the time scale promotion.

It is further added that the benefit of time scale promotion is to be extent of personal up gradation only.

Formal promotion in cases where promotion channel is available shall continue to be made in the prescribed manners.

  1. Further necessary action may be taken accordingly.

Sub:     TIME SCALE PROMOTION TO OFFICERS/OFFICIALS HAVING PROMOTION               CHANNELS: 

            I am directed to refer to subject cited above and to state that the Governor of the Punjab has been pleased to allow time scale promotion/personal up-gradation w.e.f. 01-02-2019, as one-time dispensation as under:

  1. The officers/officials who have served for more than 10 years of regular service in the same scale but could not be promoted despite having promotion channel due to fewer number of posts in the upper tier.
  2. The officers in BS-20 will not be allowed time scale promotion in terms of instant policy.
  • The employees BS-15 who have availed time scale promotion once or twice by virtue of Finance Department’s policy letter No. FD.PC.40-80/2015 dated 26-07-2017 will continue to be governed by the policy ibid. Such employees will not be allowed further time scale promotion in terms of instant policy.
  1. The officers originally appointed in BS-16 and above against stagnant posts having no promotion channel will continue to be governed by the policy letter No. FD.PC.40-80/2015 (B) dated 14-02-2019. Such employees will not be allowed further time scale promotion in terms of instant policy.
  2. The employees in BS-1 to BS-4, will also be governed by the policy letter No. FD.PC.39-14/77 (Pt IV) (APCA)/2008 (Provl) dated 21-06-2017. Such employees will not be allowed time scale promotion in terms of instant policy.
  3. The time scale promotion/personal up gradation will be subject to possession of good/satisfactory service record (no punishment or adverse remarks in the PERs) to be assessed by the competent authority through Scrutiny Committee.
  • Nomenclature of the posts held by such officers/officials will remain the same.
  1. Further premature increment is not admissible on time scale promotion / personal up-gradation.
  1. All Departments Attached Departments are requested to take further necessary action to implement the above policy.

Sub:     TIME SCALE PROMOTION TO OFFICERS IN BS-16 & ABOVE HAVING STAGNANT POSTS:

            I am directed to refer to the subject cited above and to state that the Governor of the Punjab has been pleased to allow Time Scale Promotion twice in their entire service to the officers/officials with effect from 01-02-2019, in the following prescribed manners.

  1. Officers/officials who have served for more than 10 years of service in the same scale even if they have opportunity of promotion, but they are not promoted due to a few number of posts in the higher upper tier may be upgraded to the next pay scale as personal to them as one-time dispensation, subject to the condition that they possess good/satisfactory service record.
  2. The officers in BS-16 and above having stagnant posts may also be allowed Time Scale Promotion on completion of ten years’ satisfactory service twice in their entire service.
  3. Premature increment is not admissible on grant of time scale promotion.
  1. All Departments / Attached Departments are requested to take further necessary action to implement the above policy.

  1. It is clarified for all concerned that the length of service in the same scale for the grant of time scale promotion would be counted from the date of up-gradation of the post/promotion / regular appointment (whichever is later) of the post held by the concerned incumbent.

             I am directed to refer to this department’s letter of even number dated 19-04-2019 on the subject and to state that clarifications on different issues are being sought from different quarters with reference to admissibility of time scale promotion.

  1. The issues and clarifications thereon are as under:

NO.FD.PC.40-80/2015 dated 26-07-2017, NO.FD.PC.40-12/2017 dated 19-04-2019, and NO.FD.PC.40-43/2017 (A), (B), (C), (D) & (E) dated 14-12-2018, may be read as “Time Scale Promotion Up gradation”
  The words “fewer number of posts in upper tier” mentioned in Para 1(i)  of Finance Departments letter NO.FD.PC.40-12/2017 dated 19-04-2019 needs to be revised. It is clarified that the “fewer number of posts in upper tier” would mean that posts in upper tier are less than or equal to 10% of the posts in lower tier.
  1. This issues with the approval of competent authority i.e. Chief Minister.

            I am directed to refer to this Department’s letter of even number dated 19-04-2019 on the subject noted above and to state that there are certain queries regarding modus operandi of implementation of the aforesaid letter.

  1. The case has been examined and observed that the policy ibid is applicable to the case of an officer/official who has completed 10 years’ service in a basic pay scale but has not been promoted because of insufficiency on non-availability of posts reserved of posts for promotion in the next higher pay scale in the cadre. Such officer/official is entitled to be given time scale promotion, with effect from 01-02-2019 to the next higher basic pay scale.
  1. In view of the Para 2(i) of the Finance Department’s U.O. No. FD.PC.39-14/77 (PtIV) (APCA/08) (Provl) dated 09-08-2016 read with letter No. FD.PC.39-14/77(PtIV) (APCA/08) (Provl) 04-01-2016, the time scale is allowed without DPC.
  1. In accordance with Para 2 (iii) of the Finance Department’s U.O. No. FD.PC.39-14/77(PtIV) (APCA/08) (Provl) dated 09-08-2016, no formal orders required to be issued for allowing time scale promotion to an officer/official.
  1. The officers eligible for the benefit of time scale promotion in the light of this Department’s letter dated 19-04-2019 may be advised to approach the office of the Accountant General, Punjab, / District Accounts Office concerned, as the case may, for issuance of revised pay slips in the higher scale w.e.f. 01-02-2019.

I am directed ti refer to the subject cited above and to state that a question has arisen as to whether Time Scale Personal Upgradation is admissible to the employees who is appointed against a post having no upper tier/line of promotion and has two mode of appointments I.e. by initial recruitment as well as by promotion.

2.It is clarified that the case of an employee who is appointed against a post having no upper tier/line of promotion by initial appointment would be dealt in accordance with Para 1 (ii) of the Finance Department’s Notification No. FD.PC.40-12/2017 dated 19-04-2019.  Whereas, the case of an employee who is promoted against a post but having no upper tier/line of promotion would be dealt in accordance with Para 1 (i) of the Finance Department’s Notification No. FD.PC.40-12/2017 dated 19-04-2019.

             I am directed to refer to this Department’s Notifications Nos. FD.pc40-12/2017 dated 19-04-201910-07-2019, 26-07-2019 & 20-12-2019 & clarification bearing No.FD.PC.40-80/15(115-19) dated 03-02-2019, on the subject cited above and to state that a question has arisen regarding factors in absence of which Grant of Time Scale  Personal Up-gradation to an officer/official may be considered in accordance with the applicable policy.

  1. The case has been examined and it is clarified that an officer/official who has completed 10 years in a basic pay scale may be given Time Scale Personal Up gradation in the light of Finance Department’s Notifications stated above if
  1. He/she is not hit by Para-24 of Promotion Policy-2010. It would be pertinent to mention that under Para 24 ibid the impact of foregoing of promotion is supersession.  In case promotee foregoes promotion once, he/she is superseded for three years but the second foregoing superseded permanently.
  2. No challan/reference has been filed by an Investigation Agency against him /her, and
  • He/she has not been awarded major penalty. If he/she has been awarded major penalty then subject to the following:-
  1. In case of recovery of pecuniary loss, more than five years have elapsed since start of recovery and at least 50% has been made.
  2. In case of reduction to a lower post and pay scale from the substantive or regular post for a specific period, two years have elapsed to the completion of this period.
  3. In case of forfeiture of service, forfeiture period will be deducted for calculating of service period of 10 years for Time Scale Personal Up-gradation and further two years have elapsed to the imposition of penalty.
