Sub:                       FINANCIAL ASSISTANCE TO THE FAMILY OF A CIVIL SERVANT WHO DIES   WHILE IN SERVICE.

                                               In continuation to this Department’s letter bearing same number dated 13th November 2014, on the subject noted above, I am directed to state that the Competent Authority i.e., Chief Minister, Punjab has been pleased to approve financial assistance package for families of civil servants who dies while in service.  It shall be applicable w.e.f. 22-02-2017.  The details of the said package are as under:

*For this purpose, the pay scale means in which a civil servant was drawing his/her pay.

  1. PENSION/SALARY:
  2. i) The deceased’s family shall be allowed salary, along with annual increases in the pay, the deceased officer/official was drawing till the date of superannuation of the deceased family.
  3. ii) After the date of superannuation, family pension shall be allowed as per clause 4.10 of the Punjab Civil Services Pension Rules 1987.

3. ACCOMMODATION:

The family of the deceased civil servant shall be allowed retention of Government accommodation till the age of superannuation as per provisions of the CSR (Pb.) Vol-I (Pt-I) read with the Allotment Policy issued by S&GAD vide EO(S&GAD)Policy/2009/-345 dated 19-01-2009.

  1. EDUCATION:

The educational scholarship is allowed to children of deceased civil servants (upto 3 children) out of Benevolent Fund as prescribed in the Punjab Government Servants Benevolent Funds Part I & II (Disbursement Rules 1965 & 1966.

  1. EMPLOYMENT:

Appointment of one child or widow in BS-1 to BS-11 (including the post of Patwari and Junior Clerk) on contract or regular basis as per provisions of Rules 17-A of the PCS (A&CS) Rules, 1974.

  1. MARRIAGE GRANT:

Marriage grant as prescribed in clause 3(a) & 4(a) of the Punjab Government Servants Benevolent Funds Part I & II (Disbursement) Rules 1965 & 1966.

  1. HEALTH:

Free health facilities as per their entitlement during service of the family of the deceased civil servant under the provisions of the West Pakistan Medical (Attendance) Rules 1959.

  1. NOMINATION OF AN OFFICER AS COUNSEL:

Pension/General Provident Fund Sanctioning Authority in the Department/Organization/Office shall be nominated as Counsel to assist the family in finalization of provision of entire package to deceased’s family within the shortest possible time.

  1. GENERAL PROVIDENT FUND:

GP Fund shall be paid to the deceased’s family as per provisions of the Punjab General Provident Fund Rules, 1978.

  1. MONTHLY BENEVOLENT GRANT:

Monthly Benevolent Grant shall be paid as prescribed in clause 3(d) & 4(d) of the Punjab Government Servants Benevolent Funds Part I & II (Disbursement) Rules 1965 & 1966.

  1. GROUP INSURANCE:

                Group Insurance as prescribed in the Punjab Govt. Employee Welfare Fund Ordinance, 1969.

  1. PREREQUISITE FOR FACILITATION OF FAMILY OF DECEASED CIVIL SERVANT:

Under the new simplified procedure of processing and disbursement of pension through pension roll, Direct Credit Scheme (DCS)  circulated by the Finance Department vide its letter bearing No.FD.SR-III/4-303/2012 FOR Dated 01-04-2014, a simple two-page proforma have been prescribed for all kinds of pensions, including family pension (in-service death or pensioner’s death). Action to be taken by the concerned authorities giving timelines, which have been already prescribed for the purpose.

I am directed to refer to this Department’s letter of even No. Dated 15-08-2017, and subsequent clarification issued on 12-09-2017, on the subject cited above. (copies enclosed), and further clarify the matter for convenience and guidance of all concerned, as under:-

ii Should the deductions of Group Insurance as well as Benevolent Fund continue or not? No deductions on account of Group Insurance / Benevolent Fund will be made after the death of the civil servant.
iii What should be the procedure for payment of pensionary benefits, in case a civil servant is/was working in an autonomous body etc? On the death of a civil servant, who was on deputation with an autonomous body, he/she would be considered repatriated to his/her parent department/lending organization where all of his post-death financial matters would be processed and finalized, and all deductions (except income tax) would be stopped.

The concerned payroll, office of the AG Punjab, from where the deceased civil servant processed on deputation shall verify/authenticate the rate of emoluments and forward the same to the payroll of the parent department for making payment.  It is also clarified that in case of a deceased civil servant who proceeded on deputation.  The borrowing organization / autonomous body concerned shall make necessary payment of pension contribution to the parent department of the deceased civil servant for the period he/she remained on deputation with the borrowing organization / autonomous body concerned.

The parent department of the deceased civil servant shall get created a post of OSD, till superannuation of deceased civil servant, from the Finance Department, and shall allocate sufficient funds in the budget for the subject purpose.

                  I am directed to state that in case of any confusion/query, further guidance may be sought from Finance Department so that the cases of bereaved families are disposed of timely and in appropriate manner.

          Will the Additional Accountant General, Office of the Accountant General Punjab, A.G. Complex, Turner Road, Lahore, kindly refer to his letter No. TM-12-3(IV)BF/2016-17/1395 dated 19-10-2017, on the subject noted above.

                Finance Department has examined the case and it is clarified as under:-

i The Financial Assistance is also admissible to the contract employees vide Government of the Punjab letter No. DS(OM)5-3/2004/contract dated 13-02-2009.  As to whether the widow of contract employee shall also be admissible pay up to the age of superannuation or otherwise. The deceased’s family shall be allowed net salary along with annual increases in the pay till the date of superannuation of the deceased family as per Serial-2(i) of Finance Department policy letter dated 15-08-2017. (copy enclosed)
ii Should the deceased employee whose service is less than 10 years be admissible pay up to 60 years or otherwise. Correct as per Serial-2(i) of Finance Department policy letter dated 15-08-2017. (copy enclosed)
iii In which head, the pay of the widow shall be debited.  As to whether the seat of the deceased Government servant would be deemed occupied or not.  If so, two employees can be debited against one seat. For payment of salary to the widow, the concerned Administrative Department shall get create a post of OSD till superannuation of the deceased and get allowed sufficient funds in the budget for the subject purpose as per Serial-7 of clarification dated 12-09-2017 issued to Section Officer Accounts S&GAD (copy enclosed).
iv 4 months’ pay is admissible to family of deceased Government servant from the date of death.  As to whether this 4 months pay shall also be admissible in the pursuance of the letter under reference. Four months’ salary will be given at the time of death to the deceased after the issuance of new financial assistance package as per Serial-5 of Finance Department’s letter dated 12-09-2017.(Copy enclosed)
v As to whether the deduction of G.P. Fund, Benevolent Fund, and WF shall be made from the pay of the widow up to 60 years if so, the cases of final G.O. Fund, Benevolent Fund and WF shall be finalized after 60-years when her family case was decided. No deduction on account of Group Insurance, Benevolent Fund will be made after the death of the civil servant as per Serial of the policy dated 3-10-2017 (copy enclosed) Deduction of education scholarships and marriage grants shall continue to be made from the salary.  However, G.P. Fund shall be deducted at the opinion of the family vide Serial-3 of Finance Department’s letter dated 12-09-2017 (copy enclosed).
vi If the widow dies, the family pension case or salary of the rest of family members up to 50 years is admissible or otherwise? If so which rules shall applies. In case of death of the widow, salary will remain continued to the dependents of the deceased civil servant till the age of superannuation as per Serial-2(i) of Finance Departments policy letter dated 15-08-2017 (copy enclosed). After the date of superannuation family pension shall be allowed as per Serial-2(ii) of the rule ibid.
vii As to whether the appointment of widow/son under 17-A shall be made after the superannuation / 6- years or immediately after the death of civil servant? One child or widow in BS-01 to BS-11 (including the post of Patwari and Junior Clerk) will immediately be appointed after the death of civil servant on contract or regular basis as per provisions of Rules 17-A  of the PCS (A&CS) Rules 1974 as per Serial-5 of Finance |Department policy letter dated 15-08-2017 (copy enclosed)
 
viii As to whether the final payment of G.P. Fund, Benevolent Fund & WF shall be made after 60-years or immediately after the death of civil servant. Final payment of Benevolent Fund and Group Insurance will be made immediately after the death of the civil servant.  Whereas the G.P. Fund will be paid at the opinion of the
ix As to whether death leave/leave encashment shall be admissible to the family of deceased Government servant after the issuance of the letter under reference. Death leave, leave encashment shall be admissible to the family of the deceased Government servant at the time of death as per Serial-6 of Finance Department dated 12-09-2017 (copy enclosed).

Further course of action may be taken accordingly.

2 Is there any minimum length of service required for benefits of family salary? No specific length of service is required for benefit of family salary. The family of a civil servant appointed under PCS Act, 1974, dying while in service is eligible for grant of the same.

The families of contract employees dying while in service are eligible for grant of financial assistance rates sanctioned vide FD.SR-1-3-10/2004 Dated 13-11-2014 (copy enclosed) read with S&GAD’s notification bearing NO. DS(O&M)5-3/2004Cobtract(MF) dated 13-02-2009 (copy enclosed).

3 Are probationer/contract employees also entitled for this benefit? The family of a probationer appointed under PCS Act, 1974 is entitled for benefits under revised financial assistance package circulated vide letter NO. FD.SR-1-3-10/2004 dated 15-08-2017 (copy enclosed).

However, contract employees are entitled to the extent of financial assistance only as per previous financial assistance package, circulated vide letter No. FD.SR-1/3-10/2004 dated 13-11-2014 (copy enclosed read with S&GAD’s Notification bearing No. DS(O&M)5-3/2004/Contract(MF) dated 13-02-2009 (copy enclosed)

4 Will family salary be inclusive of all allowance or otherwise? The deceased’s family will be allowed salary along with annual increases in the payless conveyance allowance.
5 What will be the status of family salary in case of remarriage or death of spouse? Family salary shall be divided equally among the surviving sons not above 24- years old and unmarried daughters as per Rule 4.10(2)(ii) of Punjab Civil Services Pension Rules.
 
6 Are parents, brothers and sisters included in definition of family for family salary? Husband/wife, children, parents, brothers (below the age of 21 years), unmarried sisters and widowed sisters of a civil servant fall under the definition of family salary in light of Para-3(A)&(B) of Finance Department’s letter No. FD.SR-1-3-10/2004 dated 15-08-2007 (copy enclosed) as explained in Rule 4.10 of Punjab Civil Pension Rules.
7 Who will be entitled to receive family salary in case of minor children when there is no Widow or Widower? Guardian of the minor children would receive family salary till their age of maturity.  Guardian certificate would be issued by the court of law.
8 Is creation of post for family salary necessary or the salary can be disbursed against an existing and vacant post of same scale. An OSD post shall be created for grant of salary till the date of superannuation of the deceased as per Serial No.2(i) of Finance Department’s letter No. FD.SR-1-3-10/2004 dated 15-08-2017 (copy enclosed) read with para-2 Serial No. of the clarification issue to Section Officer (Accounts) S&GAD vide U.O. letter No. FD.SR1/3-10/2004(P) dated 12-09-2017 (copy enclosed).  After date of superannuation, family pension shall be allowed as per Rule 4.10 of the Punjab Civil Service Pension Rules.
9 In case of death of official and his spouse will the adult and independent children be entitled benefits? In case of death of official and his spouse financial benefits shall be equally divided among the surviving sons not above 24 years and unmarried daughters as per Rule 4.10(2)(ii) of the Punjab Civil Services Pension Rules.
10 In case of dispute in family members, what would be the criteria for distribution of family salary among the beneficiaries? Family salary would be granted as per Rule 4.10 of the Punjab Civil Services Pension Rules.

 CREATION OF OSD POST FOR FAMILY SALARY OF THE DECEASED

Sub:        GUIDELINES FOR PROCESSING OF CASES REGARDING CREATION OF POST OF OSD FOR FINANCIAL ASSISTANCE OF DECEASED

                It has been observed that expenditure wing refers the routine cases for creation of post of OSD for financial assistance of the deceased employees to the regulations wing which causes unnecessary delay in processing the case and cause inconvenience to the family of the deceased employees.

  1. In order to curtail the agony of the family of the deceased all the sections of the expenditure wings are requested to examine the case properly in the light of Finance Department’s letter No.FD.SR-1/3-10/2004 dated 15-08-2017, 12-09-2017 and 03-10-2017.
  2. Further to facilitate the sections following guidelines are notified for the processing of the case for creation of post of OSD for the financial assistance of the deceased.
  3. Provision of following information /documents may be ensured from the administrative department.
  4. Attested proforma by the administrative department mentioning following details.

  8. ii) The date of superannuation needs to be calculated from the date of birth as mentioned in service book in case of non gazetted officers )copies of service book attested by the administrative department)

iii)           The date of superannuation needs to be calculated from the service period mentioned on the last salary slip in case of gazetted officers.

  1. iv) In case of discrepancy in calculation of age of superannuation from the date of birth from CNIC and date of entry in service on service book, the date on service book will be taken for calculation of age superannuation as per Rule 7.3 (note=1) of Punjab Financial Rule Volume-I.
  2. v) Finance Department has devised a list of family members to who the financial assistance may be disbursed. It includes all the family members as provided in rule 4.10 of The Punjab Civil Services Pension Rules.
  3. vi) Order for creation of post of OSD must mention name of eligible family members in whose favor post is created basic pay and pay scale of the post and time period for which post of OSD is created (beginning date is date of death and ending date is date of superannuation)

vii)          The expenditure of creation of post of OSD shall be borne by the administrative department from its own budget and same shall be mentioned in the order for creation of post of OSD is created.  However, in case the department requires additional budget separate case for supplementary budget will be moved by the administrative department.

viii)         The deceased’s family will be allowed salary along with annual increases in pay less conveyance allowance.

  1. ix) Draft order for creation of post of OSD is attached for reference.
  2. x) Draft order for the creation of post of OSD will be granted by the concerned Additional Secretary Finance Department.
  3. xi) Audit copy will be authenticated with the approval of concerned Deputy Secretary Finance Department.

   The parent department of the deceased civil servant shall get created a post of OSD, till superannuation of deceased civil servant, from the Finance Department and shall allocate sufficient funds in the budget for the subject purpose.

9 Is Succession Certificate mandatory for processing of the cases of financial assistance to the families of deceased civil servants? No Succession Certificate is not required for processing of such cases.  List of family members duly attested by the Administrative Department would serve the said purpose.

  1. It has been observed that Administrative Department while forwarding cases for creation of post of OSD to Finance Department, often, consider date of birth recorded in CNIC instead of date of birth recorded at the time of joining of Government service.
  2. Administrative Department are advised to comply the provisions of Rule ibid, while forwarding the case for creation of OSD Posts for financial assistance of family of the deceased civil servant.

                In supersession of this department’s letter of even No. FD.SR-1-5/2015 dated 07-01-2019 (B)(copy enclosed), it is advised that the Administrative Departments may henceforth forward the cases of in-service death claims to Finance Department appending therewith only the following documents:

  1. Death Certificate issued by NADRA
  2. Last Pay Slip
  • A profile of the deceased showing the following details:
  1. Mention that employee was a Regular Civil Servant
  2. Name
  3. Father’s Name
  4. Designation
  5. Basic Pay Scale
  6. Last place of posting
  7. The matter pertaining to ascertaining the right / claim of different members to the post-death service benefits may be scrutinized by the different Administrative Departments as per policy of the government and list of documents required should be minimal and only those which are required for diligence.  Departments are requested to formulate their respective policies accordingly.

                Will the Secretary to Government of the Punjab, ———————– please refer to his letter No. —————————Dated ———————–  on the subject noted above?

  1. Finance Department agrees to create the post of OSD ———-(BS —— to ———- for the payment of salary in favor of ————————— widow of deceased/legal heir —————— in the light of Finance Department’s letter No. FD.SR-1/2004 dated 15-08-2017, 12-09-2017, 03-10-2017 under Grant No. ————————– subject to the expenditure involved would be met by the department from its existing allocated budget for the current financial year ———– after observing all codal/legal/procedural formalities.
  2. Administrative Department may got Audit Copy Authenticated by Finance Department accordingly.
  3. Administrative Department is further advised to get the post added in the next year regular budget.

SANCTION POWER RULES

GOVERNMENT OF THE PUNJAB FINANCE DEPARTMENT NO.FD.SR-1/3-3/2017 DATED LAHORE  THE 4TH JANUARY 2019

 NOTIFICATION:

                 In exercise of the powers conferred on him by Article 241 of the Constitution of the Islamic Republic of Pakistan, Governor of the Punjab is pleased to direct that in the Punjab (Civil Services) Delegation of Powers Rules, 1983, the following further amendment shall be made:

AMENDMENT

                In the Punjab (Civil Services) Delegation of Powers Rules, 1983, in Appendix ‘A’ after Sr. No.22, the following shall be inserted:

“FINANCIAL ASSISTANCE

                22-A.     Power to sanction financial assistance in case of              Full Powers

  • Deceased civil servants; and
  • Decease employee appointed or working under the Contract Appointment Policy 2004”
